John E. Bulman was elected to the Executive Committee of the Board of Directors of the American Arbitration Association at its May 2008 annual meeting held in Washington, D.C.
Christopher Little and Christopher Whitney represented a Rhode Island construction company recently awarded $5 million after a 14-day arbitration. The dispute arose over the termination of a contract when another construction firm was drawn into a multi-phase 290-unit residential community project in Tiverton. The case is noteworthy not only for the size of the award, but also for the speed and efficiency with which the arbitration was conducted. Justin S. DuClos, a 2005 graduate of Emory University School of Law, joined the firm in March 2008 after practicing at the New Orleans, Louisiana law firm of Montgomery Barnett LLP where he was engaged in complex litigation arising in the wake of Hurricane Katrina. At LMKBW, Justin will be continuing his practice in business litigation.
On March 12, 2008, Daniel Kinder presented "Winning Interest Arbitration" a seminar for public officials sponsored by the Rhode Island City and Town Management Association. The seminar covered the interest arbitration experience, union strategies and tactics, how to select a winning team at arbitration, case preparation and the winning formula.
Henry Kates joined experts in the areas of finance, accounting, and personal planning for a Program entitled “Buying or Selling a Business: Demystifying the Process.” The Program provided a guide business owners through the process of developing a successful buy or sell strategy, structuring the purchase or sale, the selling process and strategies to preserve wealth after the sale. John E. Bulman has once again been selected by his peers for inclusion in the 2008 edition of The Best Lawyers in America in the specialties of Alternative Dispute Resolution and Construction Law. Best Lawyers in America is considered the "gold standard for accuracy and integrity" in attorney ratings in the United States.
Christopher C. Whitney, John E. Bulman and Laura J. Bottaro presented a one-day seminar on December 11, 2007 at Lorman's program entitled "AIA Contracts." The AIA contract documents are probably the most utilized set of standard form documents today in the construction industry. Seminar highlights included owner-architect agreements and owner-general contractor agreements, subcontractor agreements, design-build agreements and dispute resolution.
In August 2007 at its annual meeting in San Francisco, the American Bar Association reappointed Christopher H. Little to the position of Rhode Island Chair for the State and Local Procurement Division.
Daniel K. Kinder participated in the presentation of Rhode Island Employment Law Letter's "FMLA Master Class" in Warwick, RI on May 17, 2007. This advanced interactive workshop covered the latest, most complicated FMLA situations and the skills necessary to make both case-by-case and strategic FMLA decisions.
At its annual meeting in New York City on April 30, 2007, the American Arbitration Association honored John E. Bulman as its Outstanding Director for 2007. The periodic Award recognizes a director who has significantly advanced the work of the American Arbitration Association in multiple ways beyond any reasonable expectation of board membership.
John E. Bulman and Christopher H. Little have been recognized by Chambers USA in its 2006 publication identifying America's leading lawyers for business. In this fourth edition, Chambers recommends John and Chris for their backgrounds in general commercial litigation. They join Daniel K. Kinder who is recognized for his background in employment litigation.
In July 2006, Christopher H. Little was elected to become a Fellow of the American Bar Association. Membership is limited to one-third of one percent of the lawyers in the country who are recognized for their leadership in the legal profession. There are 17 Fellows from Rhode Island.
On March 21, 2006, John E. Bulman, Daniel K. Kinder, Christopher H. Little and Christopher C. Whitney presented a comprehensive seminar entitled "Legal Issues Facing the Construction Professional in Rhode Island: The Most Common Pitfalls and How to Avoid Them."
In February 2006, the American College of Construction Lawyers elected John E. Bulman a Fellow. The ACCL is an organization dedicated to addressing the legal and technical issues facing the national and international construction industry.
Christopher C. Whitney has been named to the 2006 edition of The International Law Who's Who of Business Lawyers, an international publication that recognizes the foremost legal practioners in the international marketplace.
At the Fall 2005 meeting of the American Bar Association's Forum on the Construction Industry held in Toronto, Christopher C. Whitney spoke on the topic of "Ten Key Decisions to a Successful Construction Project."
Christopher H. Little was appointed Rhode Island chair of the American Bar Association's section on Public Contracts in August 2005.
In Summer 2005, John E. Bulman was appointed as the attorney representative to the Construction Management Program Professional Advisory Board for the Roger Williams University Construction Management degree program. The Board is composed of executives from major construction firms and other professionals to advise, support and enhance the construction management degree program at Roger Williams University.
In June 2005, Christopher C. Whitney presented the topic "Public Construction Law in Rhode Island" to members in attendance at the Rhode Island Bar Association's Annual Meeting.
In Dublin, Ireland on May 20, 2005, John E. Bulman taught the inaugural session of the Arbitrator Continuing Education course "Chairing an Arbitration Panel" to members of the Board of Directors of the American Arbitration Association.
On May 18, 2005 and May 20, 2005, respectively, Christopher H. Little was among faculty members presenting the one-day seminars for Lorman Education Services entitled “Public Contract Code and Competitive Public Bidding in Rhode Island” and “The Fundamentals of Construction Contracts: Understanding the Issues in Rhode Island."
Christopher H. Little and Christopher C. Whitney were selected by their peers to be included among the “Best Lawyers in America” 2005-06 for their expertise in the field of construction law. Only three Rhode Island lawyers merit this distinction. They join Matt Medeiros, who is included again this year for his expertise in commercial litigation.
On March 11, 2005 John E. Bulman presented the topic "An Arbitration Best Practices Guide" at the AAA Seminar of the Northeast Case Management Center.
In March 2005 Matthew F. Medeiros and John D. Deacon won a five-week federal court non-jury trial of a commercial breach of contract and fraud suit. The dispute concerned an enforceable “agreement to agree” on the terms of a future requirements contract. In a 27 page decision, the court held that LMKBW’s client had fully performed its contractual obligations to negotiate in good faith. The court also rejected adversary’s 10 million dollar fraud claim, which alleged that LMKBW’s client had never intended to enter into a future contract at all. The trial presented many challenging evidentiary issues, including adversary’s last-minute disclosure of a “smoking-gun” witness.
In February of 2005, Christopher H. Little's Roger Williams Law Review article The Rhode Island Mechanic's Lien Law: A Plea (and Proposal) for Clarity and Fairness, Roger Williams L.Rev. 207 (1998) was prominently cited by the Supreme Court in its decision upholding the constitutionality of the mechanics’ lien law.
Christopher H. Little was asked by Roger Williams Law School to assist in the coaching of their national moot court team competing in February 2005 with Pace University in environmental law.
