His experience includes matters involving differing site conditions, trade secrets, mechanics' liens and design-build contracts. Tom represented an owner of a new hotel project against design-build contractor in a 15-day arbitration before a three-person panel and negotiated and coordinated terms of settlements with subcontractors. He successfully obtained an arbitration award and judgment discharging a mechanic's lien and an affirmative recovery against a contractor. Tom also represented a utility owner against a contractor in a differing site conditions claim; prosecuted the misappropriation of trade secrets; and defended a design professional in an action asserted by residential home owners. Tom began his practice of law with Lang, Richert & Patch in Fresno, California. There, he represented an owner in a construction defect matter and successfully obtained a settlement in excess of the general contract sum. He also assisted general contractors in matters such as a $35 million airport expansion construction dispute and a $10 million road construction dispute. In March 2007, Tom joined LMKBW.
