Bulman presented a session entitled Optimizing the Arbitration Hearing for Your Client. During this Conference, noted industry experts discussed ways to effectively resolve unexpected and difficult issues arising in construction arbitration. Legislating Construction Contract Terms and Conditions October 15-16, 2009 Christopher H. Little was the moderator of this plenary program held at the 2009 Fall Meeting of the American Bar Association Forum on the Construction Industry. The program examined in depth the impact of state legislation on substantive contract provisions including dispute resolution requirements, payment terms, security, and choice of law provisions. The Anatomy of the Melt Down of the Closely Held Corporation June 18 & 19, 2009 Thomas M. Madden and John D. Deacon presented this intermediate/advanced level workshop at the 2009 Annual Meeting of the RI Bar Association. The workshop addressed underlying relational issues occurring in shareholder disputes in closely-held corporations. The speakers discussion included preventative lawyering, alternatives to litigation, and a review of recent cases involving the breakup of closely-held corporations. Optimizing the Hearing in Arbitration for Your Client May 29, 2009 John E. Bulman was one of two faculty participants presenting this program which was held at The Spring 2009 American Arbitration Association Construction Conference: Maximizing ADR Advocacy for Today’s Economy in New York, NY. The workshop addressed scheduling, using different types of evidence and testimony in arbitration, arbitration hearings compared to court trials and identification of issues and key documents in advance of hearings. Employment Law Update February 26, 2009 Sara A. Rapport and Thomas M. Madden participated in this seminar held in Providence, RI sponsored by Sterling Education Services, Inc. Their presentation focused on managing employees in a down economy and included discussion of terminations, furloughs and general at-will employment. Teachers’ Rights in the 21st Century January 12, 2009 Sara A. Rapport was among the distinguished faculty presenting this seminar for the National Business Institute. Sara provided an overview of applicable laws and their impact on teachers’ rights which included: Federal and State Laws on Discrimination and Sexual Harassment, Disability Statutes, the Age Discrimination in Employment Act (ADEA), Family and Medical Leave Act (FMLA) and Fair Labor Standards Act (FLSA). Little is one of two co-editors of A State-by-State Guide to Construction and Design Law, Second Edition published by the American Bar Association in August 2009. The guide outlines design and construction law and contracting practices in all 50 states, the District of Columbia and Puerto Rico. He and R. Thomas Dunn were authors of the Rhode Island chapter of the compendium. LITIGATION HIGHLIGHTSMatthew F. Medeiros May 2010 FEPA An employee filed a charge of discrimination against Citadel Broadcasting Corporation with the Rhode Island Commission for Human Rights upon her termination from employment alleging violation of the Fair Employment Practices Act (FEPA). Although neither her employment nor the alleged unlawful actions occurred in Rhode Island, she argued that the Commission had jurisdiction. The Commission agreed with Matt's position that there is no extraterritorial jurisdiction under the FEPA and dismissed the allegations. This is the first time this important issue has ever been decided. Matthew F. Medeiros February 2010 Wills/Trusts Matt Medeiros won summary judgment for the defendant in Rhode Island Superior Court in a case of first impression in Rhode Island challenging a spouse's exercise of a power of appointment. Matt previously succeeded in getting the Probate Court to quash subpoenas that the same adversary beneficiaries had issued, for decedent's terminal health care records, in another issue of first impression. Matthew F. Medeiros November 2009 Real Estate Matt won declaratory judgment for defendant that its right of first refusal was valid and enforceable against real property plaintiff offered to buy. Plaintiff's P&S was nullified by defendant's right of first refusal and exercise of that right. The Court ruled that plaintiff had no standing to challenge the enforceability of defendant's right of first refusal and ordered plaintiff to discharge his notice of lis pendens. Medeiros February 2009 Matt obtained the dismissal of all claims against Citadel Broadcasting Company in the Station Fire litigation in federal court in Rhode Island. The plaintiffs are survivors of 100 nightclub patrons who died in the fire, as well as another 200 who were injured. They sued over 150 defendants. With the assistance of Scott K. Pomeroy, Matt moved for summary judgment on behalf of Citadel and presented oral argument. Following the argument, plaintiffs agreed to drop all claims against Citadel, which made it one of the only defendants that did not settle. Matt represents Citadel in a variety of litigation. Christopher H. Little and Christopher C. Whitney January 2008 Chris Little and Chris Whitney represented a Rhode Island construction company recently awarded $5 million after a 14-day arbitration. The dispute arose over the termination of a contract when another construction firm was drawn into a multi-phase 290-unit residential community project in Tiverton. The case is noteworthy not only for the size of the award, but also for the speed and efficiency with which the arbitration was conducted.
