Business Dispute ResolutionWe provide a variety of services to our business clients, from assisting in selecting the type of organizational entity under which to operate, to financing, professional practices, basic legal consulting to reorganizations, restructuring and resolution of complex issues. - Represented a Rhode Island based construction manager in a claim arising out of its termination on a contract to construct 260 luxury condominium units in Tiverton, Rhode Island. As a result of the litigation, the construction manager collected in excess of $5 million following the arbitrator's award issued in December 2007.
- Successfully defended various claims filed by contractors against a large regional sewer authority serving Rhode Island in a $600 million project involving combined sewer overflow.
- Claim for equitable subrogation against a lender arising out of a receivership proceeding involving a substantial nursing home failure located in Providence, Rhode Island settled for payment of $950,000 to contractor following mediation. Contractor successfully asserted that it should be able under a theory of equitable subrogation to secure priority over the secured party whom would otherwise take all of the proceeds from the receivership.
- Obtained the dismissal of all claims against a broadcasting company in a nightclub fire litigation in federal court in Rhode Island with over 150 defendants sued. Moved for summary judgment and all claims against the broadcasting company were dropped, making it one of the only defendants that did not settle.
- Won a 5 week federal court trial of a commercial breach of contract and fraud suit against our multinational client in which opposing party was demanding $10,000,000. This was the second complete victory; the first had resulted in an appeal leading to the recent trial.
- Won a settlement of $4.8 million for a manufacturer in suit against its bank for its role in an embezzlement by the manufacturer's prior president. Bank was represented by two of the largest law firms in New England.
- Developed successful defense of multimillion dollar indemnity claim against public company engaged in lending industry. Required discovery throughout the United States and management and effective use of thousands of financial documents.
