Highlights

Represented a Rhode Island based construction manager in a claim arising out of its termination on a contract to construct 260 luxury condominium units in Tiverton, Rhode Island. As a result of the litigation, the construction manager collected in excess of $5 million following the arbitrator's award issued in December 2007.

Successfully defended various claims filed by contractors against a large regional sewer authority serving Rhode Island in a $600 million project involving combined sewer overflow.

Defended a wrongful termination claim asserted by a contractor against a hotel developer seeking $2.6 million. Obtained an arbitration award striking all of contractor's claims and awarding approximately $600,000.

Claim for equitable subrogation against a lender arising out of a receivership proceeding involving a substantial nursing home failure located in Providence, Rhode Island settled for payment of $950,000 to contractor following mediation. Contractor successfully asserted that it should be able under a theory of equitable subrogation to secure priority over the secured party whom would otherwise take all of the proceeds from the receivership.

Obtained the dismissal of all claims against a broadcasting company in a nightclub fire litigation in federal court in Rhode Island with over 150 defendants sued. Moved for summary judgment and all claims against the broadcasting company were dropped, making it one of the only defendants that did not settle.
